| The State Appellate Defender’s Office is charged with the responsibility
of providing forms and information to those wishing to Seal or Expunge
certain court records. A link will be provided below for additional information
from that office.
Read all instructions and forms at the link below carefully to make sure you are eligible and which forms you should use. Do not sign your forms until you are before a Notary Public. The Circuit Clerk has staff available to witness your signature, if necessary. YOU MUST HAVE A PHOTO ID WITH YOU AT THE TIME OF SIGNING. In McLean County-the following procedures will apply: The cost of Sealing or Expunging a Court Record is a total of $136.00 This includes a $60.00 filing fee, a $60.00 State Police fee and 4 certified copies of the court order necessary to complete the process with the various agencies involved. If more than 4 certified copies are necessary, the cost is 4.00 per set. The Circuit Clerk will mail the certified copies to the agencies for you upon completion of the process. Make your check or money order payable to McLean County Circuit Clerk. You may pay cash if present in person. DO NOT SEND CASH THROUGH THE MAIL. To schedule a court date, call the Judge’s Office at (309) 888-5220. If the Court decides not to grant your petition, the Circuit Clerk will issue a refund of the $60.00 State Police fee and the $16.00 for the 4 certified copies of the Court Order. The $60.00 Filing fee is not refundable. Refund checks take 24 hours to process and can be mailed.
